TOBEA GO APPLICATION TERMS OF USE

These Terms of Use (“Terms”) govern the access to and use of the TOBEA Go mobile application (“Application”) and the mobility scooter rental services and related equipment provided by TOBEA S.A. (“TOBEA”, “Company”, “we”, “us”).

By creating an account, accessing, or using the Application, you acknowledge that you have read, understood and agree to be bound by these Terms.

If you do not agree with these Terms, you may not use the Application or the Services.

 

  1. Definitions

For the purposes of these Terms, the following definitions apply:

Application: the TOBEA Go mobile software through which the Services are provided.

Services: all functionalities provided through the Application, including locating, reserving, and renting mobility scooters.

Product / Products: mobility scooters or any mobility equipment made available for rental through the Application.

User: any natural person who creates an account and uses the Services.

 

  1. Description of Services

TOBEA provides micromobility services through mobility scooters that can be located, reserved, and rented via the Application.

The Services may include:

  • locating available equipment
  • reserving a mobility scooter
  • starting and ending rentals
  • payments through the application
  • information regarding permitted usage and parking areas

The Company reserves the right to modify, suspend, or discontinue any part of the Services.

 

  1. Modification of Terms

TOBEA reserves the right to modify these Terms at any time.

Modifications take effect upon publication within the Application.

Continued use of the Services after modifications constitutes acceptance of the updated Terms.

 

  1. Eligibility Requirements

To use the Services, users must:

  • be at least 18 years old
  • have full legal capacity
  • be capable of safely operating a mobility scooter

The user confirms that:

  • they are capable of using the Product safely
  • they understand the risks associated with mobility scooter use

The Company may deny or terminate access if these requirements are not met.

 

  1. Account Creation

Use of the Services requires the creation of an account.

The user must provide:

  • accurate personal information
  • contact details
  • a valid payment method

Accounts are personal and may not be used by third parties.

The user is responsible for all activities conducted through their account.

TOBEA may suspend or delete accounts in cases of:

  • false information
  • fraud
  • violation of these Terms.

 

  1. Rental Agreement

When a ride is started through the Application, a rental agreement is concluded between the user and TOBEA.

The rental period begins when the Product is activated and ends when the ride is completed.

The Product remains the exclusive property of TOBEA.

 

  1. Rules of Use

Users agree that they will:

  • use the Product only for personal mobility
  • comply with applicable laws
  • not operate the Product under the influence of alcohol or drugs
  • not carry passengers or animals

The following are prohibited:

  • racing or dangerous activities
  • commercial use of the Product
  • resale or subleasing of the Product

 

  1. Safety Check

Before each use, the user must check:

  • the overall condition of the Product
  • brake functionality
  • lights
  • any visible damage

If any issue is identified, the user must stop using the Product and notify the Company.

 

  1. Usage Limitations

Maximum user weight: 136 kg.

The Product may only be used by the user who initiated the rental.

 

  1. Usage Areas

Products may only be used in areas displayed within the Application.

The Company may apply:

  • restricted zones
  • no-ride zones
  • mandatory parking zones

 

  1. Damage to the Product

The user is responsible for any damage occurring during the rental.

The Company may charge for:

  • repair costs
  • replacement costs

The cost may reach up to €2000.

 

  1. Loss or Theft

If the Product is not returned within 48 hours, it may be considered lost or stolen.

The Company may charge the full value of the Product and notify the relevant authorities.

 

  1. Accidents

In the event of an accident, the user must:

  • notify TOBEA immediately
  • provide details of the incident
  • notify authorities where required

 

  1. Payments

Payments are processed through third-party payment providers.

Charges may include:

  • rental fees
  • service fees
  • taxes
  • damage charges
  • equipment recovery fees

 

  1. Fines

Users are responsible for any fines or penalties arising from the use of the Product.

 

  1. Assumption of Risk

The use of mobility scooters involves risks of injury.

By using the Services, the user acknowledges that they use the Product at their own risk.

 

  1. Limitation of Liability

To the maximum extent permitted by law, TOBEA shall not be liable for:

  • indirect damages
  • loss of income
  • loss of data

The Company’s total liability is limited to €85, unless otherwise required by law.

 

  1. Personal Data Protection

Personal data processing is conducted in accordance with the General Data Protection Regulation (GDPR).

 

  1. Intellectual Property

All intellectual property rights related to the Application belong to TOBEA.

The following are prohibited without written permission:

  • copying
  • modification
  • reverse engineering

 

  1. Governing Law

These Terms are governed by Greek law.

Any disputes shall be resolved by the competent courts of Greece.

Users may also use the European Online Dispute Resolution (ODR) platform.

PRIVACY POLICY

TOBEA processes personal data in accordance with the General Data Protection Regulation (GDPR).

Data collected through the Application may include:

  • name and contact details
  • account information
  • location data during service use
  • payment details (through payment providers)
  • application usage data

Data is used for:

  • providing the Services
  • processing payments
  • improving the Application
  • complying with legal obligations

Users have the right to:

  • access their data
  • correct inaccurate data
  • request deletion
  • restrict processing

SAFETY RULES

To ensure user and public safety, the following rules apply:

  • the scooter may be used by one user only
  • seatbelt must be used where applicable
  • traffic regulations must be followed
  • avoid use under the influence of alcohol

The following are prohibited:

  • using a phone while driving
  • reckless driving
  • performing stunts

 

DAMAGE AND LOSS POLICY

Users are responsible for any damage or loss of the Product during rental.

TOBEA may charge for:

  • equipment repair
  • equipment replacement
  • recovery of abandoned equipment

The maximum charge may reach €2000.

 

CANCELLATION POLICY

Users may cancel a reservation before the ride begins.

Once the rental starts, the normal usage charges apply.

TOBEA may cancel reservations due to:

  • technical issues
  • equipment unavailability
  • violation of the Terms of Use

 

PARKING POLICY

Users must park scooters:

  • only in permitted areas
  • without obstructing pedestrians or vehicles

Improper parking may result in additional charges.

 

ACCESSIBILITY STATEMENT

TOBEA is committed to providing mobility services accessible to individuals with mobility impairments.

The Application is designed to support:

  • a user-friendly interface
  • clear navigation
  • the ability to request support

FORCE MAJEURE

TOBEA shall not be liable for failure or delay in providing Services due to events beyond its reasonable control, including:

  • natural disasters
  • telecommunications or energy outages
  • government measures
  • strikes or social unrest
  • serious technical incidents

In such cases, Services may be temporarily suspended without liability.

 

INSURANCE DISCLAIMER

Use of the Products does not include user insurance unless explicitly stated in the Application.

Users are responsible for their own insurance coverage for accidents or injuries.

 

INDEMNIFICATION

Users agree to indemnify and hold harmless TOBEA and its employees and partners from any claims, damages, losses, costs, or expenses arising from:

  • violation of these Terms
  • unlawful use of the Services
  • damages caused to third parties
  • misuse of the Product

This includes reasonable legal fees.

 

TECHNICAL MALFUNCTIONS AND BATTERY

Mobility scooters operate with electrical batteries and mechanical systems that may malfunction.

Although TOBEA maintains the equipment, it cannot guarantee that:

  • battery levels will be sufficient for every trip
  • technical issues will not occur
  • the Product will always be available

Users are responsible for checking the battery level before starting a ride.

 

GEOLOCATION AND TRIP TRACKING

The Application uses GPS technology to:

  • locate available scooters
  • start and end rentals
  • verify parking zones
  • prevent loss or theft of equipment

By using the Application, users consent to the processing of location data during use of the Services.

This data is used solely for operational and safety purposes.

 

APP STORE COMPLIANCE

Use of the Application is also subject to the terms of application distribution platforms such as:

  • Apple App Store
  • Google Play Store

These providers are not responsible for the Services and are not parties to the agreement between the user and TOBEA.

 

MEDICAL / MOBILITY DISCLAIMER

TOBEA Services provide access to mobility equipment to facilitate transportation.

TOBEA:

  • does not provide medical services
  • does not provide medical advice
  • does not assess the medical suitability of users

Users confirm that they:

  • are capable of safely operating the mobility scooter, or
  • use the Product with assistance where necessary.

Use of the equipment is at the user’s own risk.

TOBEA shall not be liable for injuries, medical incidents, or other consequences arising from:

  • improper use of the equipment
  • use by individuals unable to safely operate the Product
  • pre-existing medical conditions.

Users are advised to consult a healthcare professional if they are uncertain about their ability to use mobility equipment safely.
